Call Recording Consent
Call recording consent is the permission or other lawful basis required to record or monitor a phone conversation, subject to applicable location and purpose rules.
A business may want to record calls for training, dispute resolution or lead attribution. Whether it may lawfully do so depends on the parties' locations, the applicable federal and state laws, the nature of the call and how the recording is used. In the United States, consent rules are not identical across states. A blanket statement that “one-party consent is always enough” is unsafe for operations spanning jurisdictions.
Practical implementation starts by identifying which calls are recorded, where callers and agents may be located, how notice and consent are obtained, and which systems store the files. The organization should document retention, access restrictions, vendor responsibilities and deletion processes. Recording should be disabled where the relevant legal and operational requirements cannot be met.
A prerecorded notice alone should not be treated as universally sufficient without a legal review of the actual workflow. Consent for recording also does not automatically authorize using the audio to train an AI model, sending recordings to marketing vendors or publishing customer statements. This term concerns call capture, not general website cookie consent.
